Hiring a certified process server to serve process on most civil court matters is required by Florida state law. When searching for a process server to hire, always be sure to check on the following items to avoid any problems down the road:

Certification

All process servers in Sarasota, DeSoto, and Manatee counties must be certified by Florida’s 12th Judicial Circuit. To be certified, process servers must:

Be 18 years or older
Have no mental disability
Be a Florida resident
Have a clean background and criminal history
Possess a Certificate of Good Conduct filed with the court or sheriff’s office
Passage of a training course and exam
Post a surety bond

Ethics

Ethics matters in the process serving industry since so much of the job depends on the honesty of the server. If a process server has a history of any of the following actions, move on to the next candidate:

Wearing a disguise or lying about their identity
Giving process recipients advice about their cases
Making threats or trying to intimidate process recipients
Engaging in illegal activities while working, such as breaking and entering

Behaving unethically as a process server can give a litigant grounds to request dismissal of the entire case, so don’t risk compromising everything you’ve worked for by using a shady server.

References

Request references from any process server you are considering hiring. Experienced servers should have no problem producing references that confirm their work ethic and reputation. If the server can’t produce references with no explanation, or the references do not confirm what the server has told you, make it a hard pass.
