Why You Need a Trustworthy Process Server

If you have recently filed a civil lawsuit, you have likely run into the problem of needing to get legal papers served to the other parties to the case. You can hire a private process server to handle this task for you, but you must use a registered and trustworthy process server if you want your case to be successful. Here’s why you need the most trustworthy person delivering your legal papers.

Accurate Service of Process

If your papers aren’t served appropriately, it could delay or derail your case. Your process server should be experienced and well-trained so that they can serve papers accurately. An untrustworthy process server might try to cut corners, putting your case in jeopardy.

Gutter Serves

Have you heard the term “gutter serve?” A gutter serve is when the private process server throws the papers away or otherwise disposes of them, then claims that the papers were served to the appropriate party. This practice can get your case thrown out. Although the state will remove such process servers from their lists of registered servers, there is no guarantee that a server doesn’t do this and just hasn’t been caught yet.

Doing Their Due Diligence

Sometimes the person who needs to be served just cannot be located, and the process server has to give up the chase. When that happens, you can usually get approved for some means of alternative service. However, you will not be given that option unless you, and by extension your process server, have done everything you can to find and serve the party.
