Can a Process Server Call You?

If a process server is trying to find you to serve you legal papers, you may be wondering just how they’re planning to get in touch with you. Process servers have various methods at their disposal they can use to find process recipients. In this post, we’ll find out how process servers are allowed to contact process recipients in the state of Florida.

In-Person

The most common way a process server will attempt to reach you is in person. This is because in-person service of process is the preferred method of service in Florida, so if a process server can find you in person, they can go ahead and serve you and finish their job.

Phone Calls

It’s very common for process servers to attempt to contact a process recipient via phone when they are first trying to locate them. This is often the easiest way for a process server to reach a process recipient and arrange a time to meet. In addition to calling you, the process recipient may also contact your family, friends, employer, or other known associates via phone in an attempt to locate you. There is no limit to how many times a process server may call you while attempting to serve you process.

Mail

Mail is a less popular option for contacting process recipients, but if in-person attempts and phone calls haven’t worked, a process server may drop you a note in the mail. Additionally, if the process server has to request an alternative service method to serve you, such as service by substitution or publication, they will also have to mail a copy of the process via Certified Mail to your last known address.

Electronic

While serving process via electronic means, like email or social media, is generally frowned upon in Florida, process servers can use these methods to attempt to contact or locate a process recipient. In some rare cases, judges have even approved the service of process via electronic means, especially in cases that deal with foreign persons or entities who are located outside of the U.S.
